Any Client may accept these terms and conditions without having to sign an acceptance for them to be in effect. If a client accepts a quote, such Client is understood to have understood the terms that apply and to have fully accepted these terms and conditions.
Please carefully read these terms and conditions. You have read and agreed to our terms and conditions if you make a purchase or use our services.
During the design stage and when the overall website development is finished, Cyberry IT Solutions will give the Client a chance to examine the website's appearance and content. Unless the Client tells Cyberry IT Solutions otherwise, within ten (10) days of the date the materials are made available to the Client, such materials will be taken to have been accepted and approved at the conclusion of the project.
Unless the Client specifically requests and is granted a delay, Cyberry IT Solutions will install and publicly post or deliver the Client's website on the date specified in the project proposal or at the date agreed upon with Client upon Cyberry IT Solutions receiving initial payment Cyberry IT Solutions.
In exchange, the Client promises to assign one person as a principal contact to help Cyberry IT Solutions move the commission along satisfactorily and quickly. To complete the project, Cyberry IT Solutions will need the Client to supply website content, such as text, photographs, movies, and sound files, among other things.
Being a small firm, Cyberry IT Solutions must make sure that the job we have scheduled is completed at the appointed time in order to remain productive. To make sure that your work is finished at the time scheduled, there are times when we may have to turn down offers for additional work and inquiries.
This is why we urge that you submit all necessary data at least one (1) week before the deadline for completion. If we are unable to make progress on your website because we did not receive the necessary information within the predetermined time range.
One (1) week prior to the Project's completion date, we reserve the right to close the Project and demand immediate payment of the outstanding balance if you agree to give us the necessary information but fail to do so before the predetermined deadline. Simply put, the condition above instructs us to wait until you are ready to begin before giving the go-ahead.
Cyberry IT Solutions agrees to regularly update any websites it commissions and hosts Cyberry IT Solutions. A fair use clause applies to this. If requests for updates require more than three hours of development time per site annually, Cyberry IT Solutions reserves the right to decline to update websites.
The Client acknowledges that any additional costs incurred to complete the task will be covered by the Client. This payment will be necessary prior to the purchase of the further necessary resources, with examples being the purchase of specific typefaces, stock images, plugins, etc.
Every effort is made by Cyberry IT Solutions to ensure that websites are made to be accessed by the majority of visitors. Websites are made to be compatible with the most widely used browsers right now (e.g. Firefox, Microsoft Edge, Google Chrome, etc.). The customer acknowledges that not all browsers or operating systems will perform correctly with Cyberry IT Solutions.
Cyberry IT Solutions disclaims all liability for web pages that do not render properly in outdated browser versions or in new browser versions released after the website has been built and delivered to the Client. As a result, Cyberry IT Solutions reserves the right to provide a price for any work required to modify the website's design or code in order to make it compatible with newer browser versions.
The Client must request the termination of services in writing or by email, and it will take effect once it is received. Service termination requests made over the phone will not be honored before receiving written or email confirmation. For design work finished up until the date of the first notification of cancellation, the Client will receive an invoice that must be paid in full within thirty (30) days.
Only legal uses are permitted for all Cyberry IT Solutions services. You consent to defend and hold harmless Cyberry IT Solutions from any claims that your use of our service has injured you or any other party.
The Client grants Cyberry IT Solutions the right to publish and utilize any data, files, or graphic logos that the Client provides while keeping all copyrights therein. Any data or files that are protected by a third party's copyright must be used with the Client's consent and within the bounds of those rights. The Client further agrees to grant Cyberry IT Solutions the necessary licenses and rights for the use of the same, as well as to defend Cyberry IT Solutions against any legal actions stemming from the Client's carelessness or inability to get the necessary copyright permissions. The Client's assurance to Cyberry IT Solutions that all necessary licences and authorities have been obtained shall be deemed to be included in any contract for website design and/or placement. It may be necessary to provide proof of authorizations and powers.
If the Client's website is to be hosted on a different server, temporary read/write access to the Client's storage directories, which must be reachable via file transfer protocol, must be granted to Cyberry IT Solutions. Based on the project's specifics, you may also need to set up other resources on the server.
Cyberry IT Solutions disclaims all liability for any alterations made to the Client's pages after installation by a third party. These changes can be additions, adjustments, or removals, among other things.
Any prior statements, understandings, and agreements are superseded by these Terms & Conditions. The Client agrees to and accepts these Terms and Conditions by sending an email, sending a text message, or paying a deposit. Accepting our terms and conditions by making a payment online.
India law shall govern this Agreement.

The remaining provisions of this Agreement shall not be affected, and the Agreement shall not be void for the sole reason that one or more of its sections are determined to be invalid, unlawful, or unenforceable. Such invalid, unlawful, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that is mutually acceptable and that most closely matches the parties' original meaning.
